Apparently, Cosby did not receive the message, prosecutors say because made a second pass at Constand during a subsequent encounter.

That led current Montgomery County District Attorney Risa Vetri Ferman to overrule her predecessor and bring the charge on Wednesday, setting the stage for what is likely to be a huge celebrity trial.

Who is the woman accusing him?

Prosecutors in Pennsylvania revived an almost decade-old investigation and now say that Cosby drugged and assaulted Andrea Constand in 2004.

According to Constand's lawsuit, Cosby told her he wanted to "offer her assistance in pursuit of a different career".

Why wasn't he charged in 2005?

A legal representative for 42-year-old Costand, who now lives in Ontario, Canada, has thanked the prosecutor on behalf of her client. Soon after welcoming Constand, Cosby provided her pills and wine to get her to relax, according to the complaint.

Constand settled the civil case against Cosby in 2006.

Might more criminal charges come from other claims?

Over the summer, a judge unsealed documents from that lawsuit - including the deposition from Cosby regarding Quaaludes, a sedative that was popular in the 1970s.

The prosecutor acknowledged that his office acted now because time was running out to charge Cosby in the case.

His victory in November was celebrated as historic because he was the first democrat to be elected as district attorney in Montgomery county and promised justice for Cosby's victims. The AP generally does not identify people who say they have been sexually assaulted unless they agree to have their names published, as Constand has done.

It was earlier this month on December 14th that Cosby, 78, sued seven accusers for defamation, the same seven who has sued him - until a later suit against model Beverly Johnson was filed a week later.

"Unfortunately, for most of the women who allege that they are victims of Mr. Cosby, it is too late for their allegations to be the subject of a criminal prosecution or a civil case because of the arbitrary and restrictive time limits set by law", Allred said. Nonetheless, Cosby's side put out a statement saying that Cosby's accusers deliberately put out, "malicious, opportunistic, and false and defamatory accusations of sexual misconduct against" against Cosby.

"First of all, why did they wait so long to make their charges against him?"

She claimed that she had been tricked into taking drugs before being sexually assaulted by Cosby. He also allegedly encouraged her to drink a number of glasses of wine. "The charge by the Montgomery County District Attorney's office came as no surprise, filed 12 years after the alleged incident and coming on the heels of a hotly contested election for this county's DA during which this case was made the focal point", said Cosby's attorney, Monique Pressley, in a statement to ABC News.

When the judge said, "Good luck, Mr. Cosby", he shouted: "Thank you!" He is counter-suing Tamara Green, Therese Serignese, Linda Traitz, Louisa Moritz, Barbara Bowman, Joan Tarshis and Angela Leslie.
