Bill Cosby Charged With Sexual Assault, Posts $1 Million Bail

On the same day her husband was charged with aggravated indecent assault Bill Cosby's wife filed to fight a deposition subpoena

Constand, who worked for the women's basketball team at Temple, where Cosby was a trustee and proud alumnus, said she was assaulted after going to his home in January 2004 for some career advice.

Advocates for survivors of sexual violence expressed relief and appreciation that famous comedian Bill Cosby was charged Wednesday with aggravated indecent assault in Pennsylvania, after years of lurid allegations he has vigorously denied.

Bill Cosby arrives in court to be arraigned in Elkins Park, Pa. on Wednesday.

Bail was set at $1m, of which Cosby will have to pay 10% on Wednesday.

"There is a fatal difference now between Cliff Huxtable and Bill Cosby that can never be overcome", said author and professor Michael Eric Dyson, who wrote a book on Cosby a decade ago.

The entire proceeding lasted for several minutes, and Cosby, walking with a cane, emerged from the courthouse to climb back into the black sport utility vehicle that brought him to the hearing and was driven away.

"This is a felony of the first degree", Kevin Steele, assistant district attorney for the state's Montgomery County, told reporters in Norristown, in the suburbs of Philadelphia.

This particular criminal charge relates to an incident which occurred at his Cheltenham mansion in 2004 where he was accused of drugging and sexually assaulting a woman.

Neither Cosby nor his representatives could be reached for comment. Cosby countersued, denying the allegations and saying the women were lying for financial gain.

That evidence, Steele said, came from court documents related to a civil suit that Constand filed against Cosby after prosecutors declined to seek charges against the comedian.

Dolores Troiani says Andrea Constand appreciates the consideration and courtesy that investigators have shown in the reopened case. Still, she called it "refreshing" that Cosby was charged. "The victim lay down... and Cosby positioned himself behind her. Cosby then fondled the victim's breasts, put his hands inside her trousers, and penetrated her vagina with his fingers", prosecutors said.

Steele said the charges stemmed from new evidence in the case that came to light in July, prompting the reopening of the investigation.

Helen Gumple, a former model and actress who now lives with her husband in CT, told necn by phone Wednesday that she is glad accusations against Cosby have been taken seriously. His lawyers also didn't comment.

Many of them occurred decades ago and the statute of limitations for prosecuting them expired long ago.

In it, Cosby admits he had sexual relationships with at least five women outside his marriage, gave prescription sedatives to women he wanted to have sex with and tried to hide affairs from his wife.

He said the woman has said she was "frozen, paralyzed, unable to move", so she was therefore unable to consent to sexual activity.

At one point in his deposition, Cosby said he recalled thinking, "Tell your mother about the orgasm".

Prosecutors in court documents cited Cosby's "evasive and conflicting identifications of the drug he gave the victim" as a key factor in their decision to charge him. In October 2014, a video of a standup routine in which he called Cosby a "rapist" went viral, and soon after, women started coming forward with claims that they were drugged and assaulted by the TV legend. Cosby said the women's accusations hurt his reputation so much that plans for a new family comedy on NBC were derailed. The judge could decide such testimony would be unfair to Cosby.
